States Actively Oppose The Attempted Title IX Rewrite

Editors’ Note: So far, we have not heard a peep out of Governor Hobbs or Attorney General Mayes on the Biden Administration’s twisting of Title IX. For many Democrats, what women need is unrestricted state-funded abortions, but otherwise, it is OK to define them out of existence. This is a great opportunity for Republicans to show leadership. We hope that urban single women, the backbone of the Democrat Party will take note.
“Do not comply. Fight.” That’s Megyn Kelly’s pugnacious response to the final Title IX regulations the Biden administration released last Friday. The education leaders of Louisiana, South Carolina, Wyoming, and Oklahoma also oppose the sweeping regulations, which attempt to socially engineer society and educational environments nationwide by redefining “sex” as “gender identity.”
The State Superintendent of Education in Louisiana, Cade Brumley, issued a memo this week to the state’s school system leaders and school boards, declaring that “it remains my position that schools should not alter policies or procedures at this time.” After outlining his concerns with the Biden administration’s Title IX regulations, Superintendent Brumley encouraged school districts to consult with their legal counsel. Among Brumley’s concerns:
The Title IX rule changes recklessly endanger students and seek to dismantle equal opportunities for females.
Schools would be required to allow biological males who identify as females to receive access to women and girls’ locker rooms and school restrooms or face sanctions for a rule violation on the basis of sex discrimination.
The new rule could force educators to reference students by names and pronouns not consistent with their biological sex and also erode parent notification of such student desires. It could also force schools to establish extensive bureaucracies to police free speech on campus.
These new Title IX rules could be in direct contradiction with Louisiana’s Fairness in Women’s Sports Act, a law that affirms school-sanctioned athletic participation must be divided by biological sex unless the configuration is co-ed in nature. While ED claims these new rules do not speak to sports, the new rules explicitly mentions [sic] athletics over 30 times.
When the U.S. Department of Education’s Title IX regulations go into effect on August 1, 2024, every school or education program that accepts federal funding will be required to allow males to self-identify into women’s spaces, sports, and educational opportunities. Brumley’s memo correctly states, “It is inevitable that there will be a legal challenge to the new rules.” The Independent Women’s Law Center is preparing to sue the Biden administration and stop the implementation of the unlawful Title IX rules.
