Another Illegal Immigrant Protected by Local Sanctuary Laws Charged with Violent Crimes

In yet another disturbing example of the devastation caused by open border policies, an illegal immigrant who entered the U.S. as a child a decade ago has been charged with first-degree rape, kidnapping and armed robbery in a county that proudly offers migrants sanctuary. The 20-year-old, Jose Roberto Hernandez-Penal, is accused of raping a woman and robbing her friend this month at a Maryland park after threatening the women with a machete. Days earlier police say he raped a 15-year-old girl at the same park in Montgomery County, which has long protected illegal aliens from federal authorities.

The illegal immigrant lives in Hyattsville, which sits in another Maryland county—Prince George’s—famous for its sanctuary policies. The measures protect illegal aliens by, among other things, releasing even the most dangerous criminals from jail to shield them from deportation. Hernandez-Penal, a native of El Salvador, entered the country illegally in 2013, Immigration and Customs Enforcement (ICE) told a local media outlet, and was “ordered removed in absentia by an immigration judge” about a year later and again approximately seven months after that. Nevertheless, he remained in the country and committed heinous crimes against unsuspecting residents. Police say at approximately 2:40 p.m. on May 16 Hernandez-Penal approached two adult females on the Northwest Brach Trail of Burnt Mills East Special Park, displayed a machete, stole their property and sexually assaulted one of the victims. Upon leaving the scene, the illegal immigrant assaulted an adult male. Officials told several local news outlets that Hernandez-Penal is also suspected of raping a 15-year-old girl on the same trail of the two-acre facility a week earlier. The park is one of hundreds operated by Montgomery County along with other recreational facilities such as basketball courts, campsites, tennis courts and playgrounds.

Detectives handling the case for the Montgomery County Police Department believe there may be additional victims of sexual assault by Hernandez-Penal that have not contacted authorities. The agency reveals that the illegal immigrant “made statements of involvement” during interviews with detectives after his recent arrest. He was then transported to the Montgomery County Central Processing Unit where he was charged with first degree rape, first degree assault, second degree assault, armed robbery, kidnapping, and weapons-related crimes. In its news release detectives urge anyone who may have been a victim of Hernandez-Penal to contact the agency’s Special Victims Investigations Division (SVID).

It is important to note that this is the same law enforcement agency that regularly releases dangerous criminals like Hernandez-Penal from jail to protect them from federal authorities. For example, a few years ago an illegal immigrant from El Salvador who raped a seven-year-old girl multiple times was released because under Montgomery County’s sanctuary law police is banned from cooperating with the feds. Rather than honor a detainer issued by ICE under a partnership known as 287(g) that notifies the federal agency of inmates in the country illegally so that they can be deported, local officials freed the child rapist on bond. Not surprisingly, the rapist vanished. Prince George’s County, where Hernandez-Penal lives, practices the same sanctuary measures. In fact, ICE has resorted to unconventional methods to capture criminals in both jurisdictions. In one instance the agency preempted Montgomery and Prince George’s counties’ imminent release of a batch of illegal immigrant offenders by publicly disclosing their identity, complete with mug shots. Most were incarcerated for sexual crimes involving children, including rape and serious physical abuse that resulted in death. A couple were jailed for murder and assault.

The Maryland cases are part of a national crises generated by local governments around the country that offer violent illegal immigrants sanctuary. Under 287(g), ICE is notified of jail inmates in the country illegally so that they can be deported after serving time for state crimes or making bail. Unfortunately, a growing number of city and county law enforcement agencies are instead releasing the illegal aliens—many with serious convictions such as child sex offenses, rape and murder—rather than turn them over to federal authorities for removal.

Report: Thousands of non-citizens PLAGUE PA voter rolls

A new report from the Public Interest Legal Foundation (PILF) has found that tens of thousands of non-citizen voters have been potentially identified in several counties across the country, casting further doubt on the already tarnished election processes in America today, Just the News reported.

The outlet revealed that in 2017, a Philadelphia city commissioner told a Pennsylvania Senate committee that there were more than 100,000 voter registration matches to Pennsylvania driver’s license numbers that included indicators for the Immigration and Naturalization Service.

Even worse, non-citizens have been found on the voter rolls in North Carolina, Arizona’s Maricopa County, and Texas.

As reported by RSBN, Pennsylvania recently settled a lawsuit with constitutional watchdog group Judicial Watch, after finding 178,258 “ineligible” voter registrations. The state agreed to settle the case and pay $15,000 to Judicial Watch with the agreement that they would remove all erroneous voter registrations identified in the suit.

Per Just the News, most of the non-citizens on the Pennsylvania voter rolls are “motor voter registrations,” which means these individuals signed up to vote when they were submitting their driver’s license applications.[…]

In the Keystone State, election processes have become increasingly muddied over the past few years, as mail-in ballots have added a new level of complexity to vote counting. In November 2022, President Trump slammed the long-winded vote-counting process in the midterms, when then-Senate candidate Dr. Mehmet Oz was running for office.

Democrat Asks Biden to Send Illegal Immigrants to Every Town in America

Republicans and one of the nation’s most prominent Democrats agree on one issue: America’s open border with Mexico has created a humanitarian crisis that has stretched multiple cities’ resources to the breaking point. Yet while Republicans focus on increased border security, at least one Democrat wants the Biden administration to adopt a comprehensive plan to settle illegal immigrants in every city, town, and village in the United States.

Historically unprecedented levels of illegal immigration since Joe Biden took office have created a humanitarian crisis for the most vulnerable people. Administration officials admitted last month that they had lost track of 85,000 children, roughly one of every three children who entered the U.S. illegally. “It horrifies me to think of the conditions that they possibly have been thrust into, sold into and have been distributed” into sex slavery, Rep. Matt Rosendale (R-Mont.), a member of the House Border Security Caucus, told “Washington Watch with Tony Perkins” on Monday.

“That is not humane. That is not compassionate.”

New York City Mayor Eric Adams (D) has said the uncontrolled border has drained the Big Apple’s finances to the core. Adams anticipates the sanctuary city will spend $1.4 billion on illegal immigrants this fiscal year. When asked, Adams expressed no gratitude for $30 million in federal funding provided by the Biden administration. “When you look at the price tag, $30 million comes nowhere near what the city is paying for a national problem,” Adams told “Face the Nation” on Sunday.

The city’s shelters and hotels became so overfilled that Adams began placing illegal immigrants in seven NYC public school gyms — while students were in the classrooms.

It is “unfair to the city of New York and [other] cities to carry the burden of a national problem,” Adams said — leaving critics to charge him with hypocrisy.

“For the past two years, Texas has been Ground Zero for the unprecedented surge of illegal immigration unleashed by the Biden administration that has strained resources in border communities to the breaking point,” said Dan Stein, president of the Federation for American Immigration Reform (FAIR). “Even with the efforts of Gov. Greg Abbott to move migrants away from the border, Texas is getting slammed to the tune of $13.4 billion for costs associated with illegal immigration.” Florida, led by Governor Ron DeSantis (R), pays more than $8 billion annually on programs for illegal immigrants or their children, according to a recent FAIR report that calculated the cost imposed on states.

Americans nationwide bear an ever-mounting cost for the uncontrolled border. “It’s costing [U.S.] taxpayers $150 billion a year,” said Rosendale. “Now, the cities that are starting to have this same economic impact pushed upon them are starting to recognize, yes, there is a problem.”

Adams has called on Biden to make the problem the nation’s problem by evenly distributing illegal immigrants nationwide.

“We have 108,000 cities, villages, towns. If everyone takes a small portion of that, and if it’s coordinated at the border to ensure that those who are coming here to this country in a lawful manner is actually moved throughout the entire country, it is not a burden on one city,” said Adams.

The mayor has tried to implement the process by sending illegal immigrants who arrive in his city to other locations statewide, and even to Canada. New York Governor Kathy Hochul (D) has been “a real partner” in helping Adams “find space throughout the state,” he said. “We believe the entire state should participate in a decompression strategy.”

Others were less pleased. Canadian MP Christine Fréchette learned of Adams’ “surprising” decision to bus illegal immigrants to the Canadian border in February. A month later, President Joe Biden and Canadian Prime Minister Justin Trudeau hammered out an agreement for Canada to allow 15,000 asylum-seekers to enter from the United States.

Aside from the economist cost, “the people of my city, are watching this city being transformed … the same people I protected for 22 years as a police officer,” Adams said. Illegal immigration has transformed North America, with Canada admitting three migrants for every birth and the U.S. adding three migrants for every four native American births in 2022.

All parties agree the size and scope of illegal border crossings is without parallel in U.S. history. There have been 5,429,144 illegal border encounters since February 2021, the first full month of the Biden-Harris administration, according to U.S. Customs and Border Protection (CBP). That number does not include nearly one million (989,155) gotaways, who successfully eluded Border Patrol, according to an inspector general report on how “Intensifying Conditions at the Southwest Border Are Negatively Impacting CBP and ICE Employees’ Health and Morale.” The number of total encounters at the southern border has increased 245% and gotaways increased 303% since the fiscal year 2019, the IG report found.

Altogether, border encounters and gotaways under the Biden-Harris administration totaled 6,418,299 — more than the population of the state of Missouri. Adams may have a population deficit to make up; nearly half-a-million people (468,200) moved out of New York City between April 2020 and last July — 5.3% of the city’s total population, according to U.S. Census data released last Thursday.

Adams blamed the crisis on the GOP, alleging that “Republicans have blocked comprehensive immigration reform,” by which he meant partial or full amnesty granting U.S. citizenship. Yet previous spikes in illegal immigration in 1986 and 2000 coincided with fulfilled or anticipated amnesty plans.

New York City has long touted its status as a sanctuary city. Mayor Ed Koch (D), whom The New York Times revealed as a “closeted gay man,” established New York City as a sanctuary city through Executive Order 124 on August 7, 1989. Subsequent mayors Michael Bloomberg (a Republican-turned-independent) and Bill DeBlasio (D) liberalized the categories of illegal immigrants whom the city would not turn over to the federal government for deportation.

Adams personally greeted a busload of illegal immigrants sent by Texas Governor Greg Abbott (R) last August. Adams proposed sending illegal immigrants to community college at taxpayer expense — in Sullivan County, more than 100 miles north — and he supported a city council measure allowing illegal immigrants to vote in citywide elections. The voting law was struck down by the New York Supreme Court of Richmond County last June.

Citizens in other parts of New York state have indicated they want nothing to do with Adams’ plan to relocate his illegal population. Suffolk County hired a lawyer to prevent Adams from sending illegal immigrants to their area.

Adams also reversed himself on gyms after parents expressed concerns about their children roaming the halls with unvetted adults.

But parents and communities will not receive relief until the president gets serious about border security, said Rosendale.

“We know what to do,” he said. Washington must start “completing the border wall security system — the sensing devices, the cameras, the lighting, the road that would parallel the wall. That would be a huge, huge help.”

D.C. must also reform the oft-abused asylum process, he said. “We know that by implementing the stricter standards on asylum and making sure that people really do have a threat to their lives,” rather than merely coming as economic migrants. “That’s why they’re fleeing, and they’re only coming across one border in order to gain that asylum status.”

They must also reinstate President Donald Trump’s Migrant Protection Protocols (MPP) policies. “While they had to wait in Mexico,” 75% of alleged asylum-seekers “went back to their country of origin,” casting serious doubt on their stories that they feared for their lives.

These policies can again “slow down the flow of people that are fleeing, trying to get into our country dramatically.”

New Border Numbers Show Biden’s Shell Game Isn’t Working

There’s no “90% drop in illegal immigration” in sight, as the latest border numbers from April show. At the Southern border alone, over 211,000 illegal aliens were arrested or expelled in April. This not only represents the second-highest total ever recorded for the month of April (after April 2022), but it also marks four months of steady increases. Indeed, as these data from Customs and Border Protection (CBP) demonstrate, illegal crossings at the Southwest border are climbing back towards the record high seen in December 2022.

This four-month increase comes despite the Biden Administration’s plan to hide the disastrous border situation from the public through its illegal parole programs. Since January, the Biden Administration has been flying aliens without visas from four countries (Cuba, Haiti, Nicaragua, and Venezuela) directly into the interior of the U.S. and granting them parole to avoid them from being counted at the southern border.

This program has failed to hold back the tide, however. As the data show, the number of Haitians arrested at the border in April is 42 percent higher since December – the month before the program began. Meanwhile, the number of Venezuelans arrested at the southern border since December is up a whopping 330 percent. Clearly, the magnet created by a weak border still overpowers any shell game the Administration implements to hide the numbers.

Other disturbing figures have also emerged from the April numbers release. Overall arrests of suspected terrorists are sharply up at the border. The 16 suspected terrorists arrested trying to sneak into the U.S. at the Southern border last month are more than the entire total of the previous administration.

In addition, a new front has opened up in border insecurity. The number of people crossing the Northern border illegally, normally a few thousand monthly, has been consistently over 10,000 monthly for the past year and continues to reach record highs. As the Biden administration focuses its resources on the disaster it has created at the Southern border, new opportunities for dangerous human smuggling are emerging in the North.

The Biden administration needs to come to grips with what Ponzi scheme operators have known for decades. Numbers can be easy to manipulate at first, but if the facts on the ground don’t change, the whole house of cards will always come tumbling down.

Mayor Eric Adams: Nearly Half of NYC Hotel Rooms Now Filled with Migrants

Nearly half of hotel rooms in New York City today are filled with newly arrived border crossers and illegal aliens, living rent-free at the expense of local taxpayers, Mayor Eric Adams (D) says.

Since the spring of last year, nearly 70,000 border crossers and illegal aliens have arrived in the sanctuary city of New York City — many bused from Texas by Gov. Greg Abbott (R). The figure represents a fraction of the millions of border crossers and illegal aliens who have been released into the United States interior or successfully crossed the border.

For months, Adams has been giving out lucrative contracts to the city’s powerful real estate industry which is housing tens of thousands of migrants in hotels. Most recently, for example, New Yorkers are set to foot an annual $75 million bill to put up border crossers and illegal aliens in Manhattan’s iconic Roosevelt Hotel.

This week, Adams said nearly half of the city’s hotel rooms are now filled with border crossers and illegal aliens, calling waves of illegal immigration an “onslaught” that officials are struggling to deal with and demanding President Joe Biden spread out new arrivals to towns and cities across the U.S.

“Almost 50 percent of those hotel rooms are taken up by migrant asylum seekers that we are paying for,” Adams said. “So instead of monies coming from people who are visiting us and spending in our tourism, in our Broadway plays, instead of them using those hotels, we are using those hotels.”

We have been writing about Biden’s not only opening the border but now we have video of buses being used in the dead of night to transport illegals into our nation by DHS.

Historian and Opinion Editor for the Daily Caller Michele Gama Sosa in an article titled The GOP Is Clueless To The Dems’ Sinister Immigration Agenda — And It Has Nothing To Do With Elections wrote,

The GOP has been very good at diagnosing the problems we will face from the illegal migrant invasion following the end of Title 42. Americans will pay more taxes while seeing cartel activity, gang violence, and other crime skyrocket. Housing and healthcare will become scarcer and more expensive, and the labor market will worsen as a larger labor supply suppresses American wages.

Republicans have mostly attacked the Democrats’ plan to create a “permanent majority” or accused them of enabling crime. Ultimately, this short-sighted approach focuses on the short-term electoral game. As usual, the Democrats and their handlers hide their true intentions, and the GOP is none the wiser.

The final Democrat goal is to turn America into a communist state in which Washington and its mega-corporate partners control every aspect of life. But Americans increasingly realize they are better off controlling their own affairs. So what is Uncle Sam to do?

Enter a pair of 60s radicals from Columbia University. Professors Richard Cloward and Frances Piven taught at the Ivy League university during Lyndon Johnson’s War on Poverty and Great Society. In 1966, they argued that Johnson’s welfare program was not going far enough because most welfare was the purview of state and local authorities. In order to get everyone on the federal teat, a crisis had to be created to give the feds the excuse to step in. Their proposal was to have massive numbers of poor people overwhelm local and state governments that they would beg Uncle Sam for help.

This general idea is the long-term strategy behind mass immigration.

If the Democrats cannot get Americans to accept a neo-communist, technocratic, oligarchic state run by billionaires and their political marionettes, they will import those who will. And the masses of impoverished foreigners, who are already accustomed to socialism and heavy-handed government, are the perfect trojan horse.

AOC may be dumb, but the people behind her aren’t. They want to overwhelm their own cities – and then everywhere else. They know that if NYC and Chicago can’t handle migrants, then the rural counties these cities are shipping migrants to definitely won’t – let alone the 750 million people who want to come here. The only entity left to pick up the tab is the federal government (in practice, this means you), which will use demographic chaos, poverty, and declining standards of living as a pretext to “save” the day. Coincidentally, Eric Adams has called for just that.

These illegals are now being bussed across America and filling up our cities, causing a crisis which Biden and his administration will then declare a national emergency and take over the care of these illegals all at our expense. This will not only increase the national debt but will cause services for legal citizens to decline and even be denied. We are already seeing how this is impacting America’s veterans.

The invasion will continue so long as Biden is in office. The Republicans have yet to effectively stop it. The question is why?

The key question in the 2024 GOP presidential primary is: Which candidate can and will stop and reverse this?

As Dems Ignore the Border, Cries of ‘Do Something’ Grow

Maybe President Joe Biden isn’t the only one with cognitive deficits. At a fundraising event in Atlanta Friday, his “border czar,” Vice President Kamala Harris, insisted that everything on the border is “going rather smoothly” — an absurd assessment for a country that just watched more migrants cross the border last week than fits in Dallas’s AT&T Stadium (83,000). While our country is overrun by terror suspects and drug smugglers, the crisis earned barely a shrug from the two leaders, who spent their weekends either lounging by the beach or raising money for the party defending this lawlessness.

Since Biden’s czar has obviously lost touch with the situation, Texas Governor Greg Abbott (R) decided to send a special Lone Star wake-up call. To remind Harris what border states are facing, he bussed dozens more migrants to the vice president’s residence and let them loose. As for other area accommodations, a local ABC station says that the D.C. hotels and shelters housing illegal immigrants are already at capacity. “There will be more coming,” Abbott warned leftist leaders, floating more drop-offs in New York, Philadelphia, and Chicago.

“Pray that our country will survive” was all that Rev. Franklin Graham could say.

Meanwhile, the tsunami of migrants — which included an Afghan on the America’s terror watch list — is not a catastrophe, Homeland Security Secretary Alejandro Mayorkas argued on CNN Sunday. “I would disagree [that we have fallen short],” the beleaguered Biden official said. “We have surged resources, asylum officers, Border Patrol agents, processing coordinators to do the data entry work so our Border Patrol agents can be out in the field. We’ve expanded our holding capacity in Border Patrol stations. … We’re setting up regional processing centers now. It’s extraordinary what we’ve done over the past 18 months or so.”

“Extraordinary,” yes. An extraordinary failure. Even NBC’s Savannah Guthrie didn’t hold back with Mayorkas, demanding to know why, after they’ve had “two years to prepare for this,” there’s so much “chaos and confusion” at the border. Like Biden, the secretary blames Congress. “We are operating with the constraints of a broken immigration system.”

A system, Rep. Matt Rosendale (R-Mont.) points out, that House Republicans have tried to fix — as recently as last week. This “absolutely” could have been avoided, he told “Washington Watch” guest host Jody Hice. “And what you’re seeing now is the actual policies that would keep this from taking place — the [ones] that were initiated under the Trump administration — we saw that tide of humanity slowed to a little trickle. It was policies, not money, being thrown at the border,” he explained.

“… The Remain in Mexico Policy, which I tried to get into statute two years ago and introduced a bill to do just that, says, ‘Okay, if you come to the American border and you’re going to claim asylum status, you can make that claim, but you’re not released into the United States until you await your hearing date to find out if you’re eligible. You wait in Mexico until that hearing date.’ And just by that one simple thing alone, we were able to have 75% of the people who claimed asylum status returned to their country of origin.” Solutions like that were “contained in H.R. 2 … [which the House passed Thursday]. It’s going to the Senate. And now we’re going to find out how many people are truly interested in securing the United States’s sovereignty.”

Biden, of course, is just fine with the status quo. As he said to reporters during his bike ride, throwing open the doors to America has gone “much better than you all expected.” That’s because, Rosendale pointed out, this has been the Democrats’ goal all along. They want the country to be to be invaded by foreigners who are dependent on the government and the party who let them in.

“If you go back in time and you play the quote from Secretary Mayorkas from two years ago, he said at that time, ‘We have a plan. Please allow us to carry our plan out.’ And he has, [because] his plan has been to allow as many people into our country illegally as he possibly can under this administration. … He has absolutely no intention of trying to even slow down the flow of humanity that’s coming into our country. And it’s really unfortunate, because there is a lot of suffering that is taking place [with] all of those people.”

He, like former Congressman Hice, has visited the border multiple times and witnessed the turmoil up close. “They’ve got — what is it — I think up to 85,000 children now [who] are unaccounted for that have been released into the country. Where are they located? Where have they been sent? What kind of conditions are they living in? Have they been sold into slavery? There are so many terrible things that are happening to people that are coming up into this country.”

And the expense to taxpaying Americans is astronomical. The preferential treatment Biden is giving illegal immigrants — over our own veterans, who are being booted out of shelters to house them — comes with a massive price tag. “I’ve heard estimates as much as $150 billion a year in order for us to house, Medicaid, and educate all of the illegals that are coming in.” And because of their status, Rosendale points out, “they’re not allowed to work legally. So that means they become dependent upon our entire system. So we are creating a permanent underclass. And this is not humane. And the way that these folks are treated on the way traveling here is not humane.”

As for the surge being a non-event, Senator Ron Johnson (R-Wis.) could only shake his head at the Democrats’ apathy. “Remember,” he told Family Research Council President Tony Perkins on Monday’s “Washington Watch,” “President Obama declared it a humanitarian crisis when we were apprehending about 2,000 people a day. … It’s been averaging over 8,000 people a day. … [T]his is an enormous disaster that has been caused by the Biden administration. We [had] pretty well gotten the border under control [under Trump]. We shut down the flow of unaccompanied children, of family units abusing our asylum laws. But Biden blew that open. This is completely his fault. This is his crisis.”

Biden Admin Asks Agriculture, Interior Departments For Help Stemming Tide Of Migrants Crossing Border

The Biden administration asked several departments and federal agencies, including the the U.S. Department of Agriculture (USDA) and the Department of Interior, to support border authorities ahead of the end of Title 42, the Trump-era migrant expulsion order, on May 11, according to an internal memo exclusively obtained by the Daily Caller News Foundation.

In addition to deploying Department of Homeland Security (DHS) and Defense Department (DOD) personnel to the southern border, the Biden administration also requested the deployment of Department of Justice (DOJ), Department of Agriculture (USDA), Department of Commerce and Department of Interior personnel, according to the Friday memo, which Homeland Security Investigations (HSI) Acting Executive Associate Director Katrina Berger sent internally.

“Law enforcement partners throughout DHS are being called upon to assist, and CBP’s request for support is one that is being answered across the federal government. This includes support from ICE Enforcement and Removal Operations, the Federal Protective Service, the Transportation Security Administration, the United States Coast Guard, and the United States Secret Service,” the memo stated.

“Additionally, the following departments are expected to deploy resources to support these efforts: the U.S. Department of Justice, the U.S. Department of Agriculture, the U.S. Department of Commerce, the U.S. Department of the Interior, and the U.S. Department of Defense,” the memo stated.

In the week leading up to Title 42’s end, DHS personnel saw a record surge of roughly 10,000 migrants crossing the southern border each day, according to Fox News.

By Friday, hours after the order ended, Border Patrol had more than 25,000 migrants in custody, putting several sectors along the U.S.-Mexico border over their holding capacity, according to data previously obtained by the Daily Caller News Foundation.

The Biden administration announced the deployment of 1,500 military personnel to the southern border ahead of Title 42’s end.

DHS, the USDA, the Department of Interior, the Department of Commerce and the DOJ didn’t respond to requests for comment.

The White House also didn’t respond to a request for comment.

Biden Administration Issues Mass Release Policy; Florida District Court Stops It

Just hours before the end of Title 42, the District Court for the Northern District of Florida issued a temporary restraining order (TRO) halting the implementation of the Biden Administration’s mass release policy issued by the Border Patrol only one day earlier.

The new policy, which the Border Patrol dubbed “parole with conditions,” authorized agents to release aliens who have illegally crossed the southern border through parole before they are given a Notice to Appear (NTA) in immigration court. Issuing that NTA to illegal aliens is extremely important because it officially places them in deportation proceedings. However, the new policy authorized border agents to parole illegal aliens and release them into the U.S. with only a promise that, within 60 days, the alien would self-report to an Immigration and Customs Enforcement (ICE) office to receive an NTA, or use an online portal to request that ICE send them an NTA through the mail.

Through the new policy, the Administration was clearly seeking to bypass federal law that requires detention of illegal aliens arriving at the southern border and to bypass the restrictions set forth in the parole statute, which allows parole only to be given on a case-by-case basis. Reports swirled that the Border Patrol simply planned to release illegal aliens on the streets of border communities when Border Patrol stations and NGO shelters were full.

Less than 24 hours after the Biden Administration issued the policy, the State of Florida sought to stop it. On Thursday morning, Florida’s Attorney General filed a complaint in federal district court arguing that the new “parole with conditions” policy is not only contrary to federal law, but also violates that same Court’s decision vacating a similar parole policy issued by the Biden Administration. Florida’s complaint asked the Court to declare the new policy unlawful and enjoin Homeland Security from enforcing or implementing it.

Federal Judge Wetherell agreed with Florida and issued the temporary restraining order. Judge Wetherell indeed found that the Border Patrol’s new mass release policy, called “parole with conditions” was functionally indistinguishable from the Border Patrol’s prior “parole + alternatives to detention” policy, which the same District Court determined was issued in violation of the Administrative Procedure Act (APA). The District Court rejected the Biden Administration’s claim that the new policy was not subject to the APA due to the crisis and need for urgent action. Instead, the Court pointed out that the Administration’s parole with conditions policy memo “does not explain how this surge was unexpected or why DHS waited until the day before the Title 42 Order was scheduled to end before issuing the new parole policy.”

Judge Wetherell ordered that the TRO would expire in 14 days and scheduled another hearing on May 19 to determine whether the TRO should be converted into a preliminary injunction. Until any further action in court, the Biden Administration must now process illegal aliens entering through the southern border in accordance with existing statutes and regulations issued under Title 8 of the Immigration and Nationality Act (INA).

The Biden Administration criticized Judge Wetherell’s decision to issue the TRO. “This is a harmful ruling that will result in unsafe overcrowding at CBP facilities and undercut our ability to efficiently process and remove migrants, and risks creating dangerous conditions for Border Patrol agents and migrants,” said a U.S. Customs and Border Protection (CBP) statement released in response to the order.

Biden Ends Title 42 – Ramping Up The Immigration Delivery System

The goal is obvious.

After several reprieves the Biden Administration finally ended Title 42 on My 11, 2023.

Just about a year ago as the end of Title 42 appeared imminent I wrote an article worth revisiting: Title 42 and Chaos on the Border

In that article, among other issues I provided information that appeared in a Judicial Watch report about how NGO (Non Government Organizations) were reaping huge government contracts to provide services of unknown millions of illegal aliens, calling into question the notion of referring to NGOs as “Nonprofits.”

The actions and policies of the Biden administration that pertain to immigration are utterly impossible to comprehend.

Our immigration laws, contrary to the lies of the globalists and Radical Leftists, have nothing to do with race, religion, ethnicity or bigotry and xenophobia but about protecting public health, national security, public safety and the jobs and wages of American and lawful alien workers.

A review of 8 U.S. Code § 1182 (Inadmissible aliens).will make the purpose, importance and reasonableness of our nation’s immigration laws crystal clear.

The enforcement and administration of our nation’s immigration laws profoundly impacts nearly every challenge and threat America and Americans face in this especially dangerous era beginning with national security and public safety.

My recent article addressed my concerns about how the Biden administration’s immigration policies are great exacerbating the threats America faces from foreign terrorist organizations, particularly since the disastrous U.S. withdrawal from Afghanistan. The primary shared mission of the military services of the united States is to keep America’s enemies as far from our shores as possible. Up close and in persons, that vital mission falls to the Coastguard, Customs and Border Protection (CBP) and Immigration and Customs Enforcement (ICE).

The 9/11 Commission, to which I provided testimony, was convened in the wake of the terror attacks of September 11, 2001 to identify the vulnerabilities that the 19 hijacker/terrorist exploited in order to enter the united States to carry out their deadly attacks to make certain that those vulnerabilities were addressed to prevent future such attacks.

The 9/11 Commission looked back to the decade leading up to the 9/11 terror attacks to try to leave no stone unturned.

The Commission determined that in each case multiple failures of the immigration system enabled international terrorist to easily enter the united States on multiple occasions utilizing a number of ploys and were subsequently able to “hide in plain sight” by acquiring false or altered identity documents such s driver’s licenses and committing immigration fraud as they went about their deadly preparations.

The Executive Summary of the Final 9/11 Commission Report included this excerpt:

Permeable Borders and Immigration Controls

There were opportunities for intelligence and law enforcement to exploit al Qaeda’s travel vulnerabilities. Considered collectively, the 9/11 hijackers

• included known al Qaeda operatives who could have been watchlisted;

• presented passports manipulated in a fraudulent manner;

• presented passports with suspicious indicators of extremism;

• made detectable false statements on visa applications;

• made false statements to border officials to gain entry into the United States; and

• violated immigration laws while in the United States.

Neither the State Department’s consular officers nor the Immigration and Naturalization Service’s inspectors and agents were ever considered full partners in a national counterterrorism effort. Protecting borders was not a national security issue before 9/11.

The attorneys and federal agents who were assigned to the 9/11 Commission staff produced an official report, 9/11 and Terrorist Travel – Staff Report of the National Commission on Terrorist Attacks Upon the United States.

This report focused specifically on the ability of the terrorists to travel around the world, enter the United States and ultimately embed themselves in the United States as they went about their deadly preparations and carry out an attack. The preface of this report begins with the following paragraph:

It is perhaps obvious to state that terrorists cannot plan and carry out attacks in the United States if they are unable to enter the country. Yet prior to September 11, while there were efforts to enhance border security, no agency of the U.S. government thought of border security as a tool in the counterterrorism arsenal. Indeed, even after 19 hijackers demonstrated the relative ease of obtaining a U.S. visa and gaining admission into the United States, border security still is not considered a cornerstone of national security policy. We believe, for reasons we discuss in the following pages, that it must be made one.

Page 61 contained this passage:

Exploring the Link between Human Smugglers and Terrorists

In July 2001, the CIA warned of a possible link between human smugglers and terrorist groups, including Hamas, Hezbollah, and Egyptian Islamic Jihad.149 Indeed, there is evidence to suggest that since 1999 human smugglers have facilitated the travel of terrorists associated with more than a dozen extremist groups.150 With their global reach and connections to fraudulent document vendors and corrupt government officials, human smugglers clearly have the “credentials” necessary to aid terrorist travel.

This paragraph is found on page 98 under the title “Immigration Benefits:”

Terrorists in the 1990s, as well as the September 11 hijackers, needed to find a way to stay in or embed themselves in the United States if their operational plans were to come to fruition. As already discussed, this could be accomplished legally by marrying an American citizen, achieving temporary worker status, or applying for asylum after entering. In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.

Alejandro Mayorkas is the chief architect of the Biden Administration’s immigration policies and played a similarly major role when he served the Obama administration including the creation of DACA (Deferred Action, Childhood Arrivals).

In an earlier article, Providing Former Taliban Associates with Visas and Asylum: The Biden administration continues its assault on U.S. national security I stated:

Putting Mayorkas in charge of DHS is the equivalent of putting an arsonist in charge of the fire department!

Therefore it could be said that the termination of title 42 by the Biden administration is the metaphorical equivalent of pouring an accelerant onto a raging fire!

Aliens whose identities cannot be determined or verified are being released into the United States with no regard as their actual backgrounds or potential links to criminal or terrorist organizations.

Many of these aliens have not even been given any paperwork by DHS and those aliens who have hearing dates will not be required to show up in immigration court form many years. At present, such aliens in New York City are getting hearing dates that are more than ten years from now.

As the human tsunami of aliens growing by the day, it is likely that it won’t be long before hearing dates will stretch even further into the future.

Now I as you to consider the quote I provided previously from the 9/11 Commission Staff Report on Terrorist Travel:

In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.

Terrorists will have a decade or longer to hide in plain sight as they prepare deadly terror attacks.

In this deadly game of “Hide and Seek” those who seek our demise won’t have to make much of an effort to hide because without meaningful interior enforcement, exacerbated by insane “sanctuary” policies of Radical Leftist mayors and governors there are no resources to enforce our immigration laws. (Not that Biden or Mayorkas would actually enforce our immigration laws.).

Furthermore, I have yet to hear leaders in the Republican Party call for ramping up interior enforcement- all they want to focus on is the Borer Patrol, whose mission ends when alien move from the borders of the United States to the interior of the United States.

Additionally, while the media focuses on the Southern Border, in reality, liens and contraband flow into the United States along our northern border, and along our nation’s 95,000 miles of coastline. Aliens, including criminals and terrorists also enter through America’s international airports. This was, in fact, one of the major findings of the 9/11 Commission.

Here is something for you to contemplate. Law enforcement officers who are involved in a shooting, doctors who are accused of making serious or deadly mistakes, motorists who are involved in serious accidents, airline pilots who are involved in a crash or serious mishaps all face thorough investigations and the potential for serious- perhaps life-altering consequences. They may lose their jobs, and or their licenses, they may be sued and they may even face criminal prosecutions and lengthy jail sentences.

Politicians, however are almost never held accountable for their decisions even when people, frequently, many people, lose their lives as a direct result of the decisions blithely made by our political elite with impunity and utter contempt for We the People.

This is hardly consistent with President Lincoln’s aspirational view of the government of the United States as being purportedly, “Of the People, by the People and for the People.”

The GOP Is Clueless To The Dems’ Sinister Immigration Agenda — And It Has Nothing To Do With Elections

The GOP has been very good at diagnosing the problems we will face from the illegal migrant invasion following the end of Title 42. Americans will pay more taxes while seeing cartel activity, gang violence, and other crime skyrocket. Housing and healthcare will become scarcer and more expensive, and the labor market will worsen as a larger labor supply suppresses American wages.

Republicans have mostly attacked the Democrats’ plan to create a “permanent majority” or accused them of enabling crime. Ultimately, this short-sighted approach focuses on the short-term electoral game. As usual, the Democrats and their handlers hide their true intentions, and the GOP is none the wiser.

The final Democrat goal is to turn America into a communist state in which Washington and its mega-corporate partners control every aspect of life. But Americans increasingly realize they are better off controlling their own affairs. So what is Uncle Sam to do?

Enter a pair of 60s radicals from Columbia University. Professors Richard Cloward and Frances Piven taught at the Ivy League university during Lyndon Johnson’s War on Poverty and Great Society. In 1966, they argued that Johnson’s welfare program was not going far enough because most welfare was the purview of state and local authorities. In order to get everyone on the federal teat, a crisis had to be created to give the feds the excuse to step in. Their proposal was to have massive numbers of poor people overwhelm local and state governments that they would beg Uncle Sam for help.

This general idea is the long-term strategy behind mass immigration.

If the Democrats cannot get Americans to accept a neo-communist, technocratic, oligarchic state run by billionaires and their political marionettes, they will import those who will. And the masses of impoverished foreigners, who are already accustomed to socialism and heavy-handed government, are the perfect trojan horse.

AOC may be dumb, but the people behind her aren’t. They want to overwhelm their own cities – and then everywhere else. They know that if NYC and Chicago can’t handle migrants, then the rural counties these cities are shipping migrants to definitely won’t – let alone the 750 million people who want to come here. The only entity left to pick up the tab is the federal government (in practice, this means you), which will use demographic chaos, poverty, and declining standards of living as a pretext to “save” the day. Coincidentally, Eric Adams has called for just that.

So what do you do when people can’t afford to live as a result of both low wages and high taxes to pay for all these illegals (among other things)? Enact universal basic income, preferably with a trackable CBDC that will control what you can buy, and when and whether you can buy it at all. Can’t afford healthcare because the system is strained and clogged up? Roll out medicare for all, which of course gets to prioritize certain patients over others according to federal whims. No doubt diversity and inclusion will be criteria. Local and state police can’t handle the out of control crime anymore as a result of illegal immigration and soft-on-crime DAs? Create a national police force.

COVID-19 was a good try from the feds. They got tons of people to wear masks, take experimental shots, and hate their neighbors, but it didn’t result in the economic collapse and massive run to the welfare rolls that they had hoped for. So now, they’ve hit upon an all-too-commonly seen plan in history: when your own people hate you, bring in dependent outsiders.

Oh, and one more thing. When the millions of military-aged male migrants don’t get what they want from the Dems (who basically promised them the world), the Dems will blame you (Americans) and turn their newly imported constituency against you to save themselves.

And you won’t be able to defend yourself. All that violence that is happening thanks to cartels, sex/drug trafficking, and gang violence – all the product of letting in massive numbers of military-aged males? That’s your fault too, which means: get ready to surrender your guns. Uncle Sam doesn’t like competition.

Drone Video of Illegal Aliens on Rio Grande Setting up Camps Before Biden Ended Title 42

I wish to thank the Texas Department of Public Safety for the drone footage contained in the below article. May I further thank each and every law enforcement officer, National Guardsman and fireman/medic standing post along what use to be America’s southern Border. The southern Border of the United States which helps define the national sovereignty of this exceptional nation, has, by all accounts, collapsed. This has been the plan, written and spoken about by Obama when he declared that he would “forever change America.” The well-stated and written plan is to collapse the United States into the New-World Order, a global community where nations no longer have sovereign status but are part and parcel of the global community which is divided into ten regions world wide.

Not only are approximately 1 million illegals from 160 countries coming into America commencing with the abolishment of Title 42, but you need to add the approximate 6 million illegals already here. These numbers are law enforcement and threat assessment close working estimates, minus the “get aways” who could not be interdicted, recorded, checked or even detained. It is well known that hardened criminals and gang members along with military age Chinese males have made their way across the border already, NOT counting what is now crossing. The danger being allowed into America is beyond comprehension. May 6th at the Douglas, Arizona border crossing, US Customs discovered and IED (explosive device) being smuggled into our country. Cartels and Chinese military have been sending weapons and munitions for many months securing them in storage lockers at various locations across America.

Another dimension not even discussed is the medical crisis looming. My national show ARIZONA TODAY will have a presentation on this sobering and alarming dimension shortly. I already did two shows on this subject, but as I write this report one of my nationally recognized medical specialists contacted me with updated medical concerns of a serious nature now landing on our lands.

Joe Biden, Barack Obama, and each elected office holder who has not vigorously fought to protect and defend the sovereignty of the United States should be impeached or arrested for treason. Deliberately, publicly and consistently pushing to weaken our national sovereignty is a High Crime and Misdemeanor – Treason as outlined in our Constitution. Such acts are far and above political rhetoric or grandstanding. Very shortly, within days even, Americans will witness, firsthand, the effects of said treason as 1 million pour into America. Do your very best to get ready…an ugly human tidal wave is about to become reality, and quite possibly in your city or community as they are deliberately transported across America, especially into historically conservative communities and regions. That is the well thought out plan to bring disruption and even chaos to America.

Drone footage shows makeshift camps built along Rio Grande by migrants waiting for Title 42 to end

Drone footage taken along Rio Grande, the river that serves as the natural border between most of Mexico and the United States, shows sprawling tent encampments stretching out all over the border.

Hundreds of people reside in a massive camp made of tents and other dwellings with thin blue plastic sheets acting as roofs right outside of Brownsville, near the southern tip of Texas. (Related: Thousands of migrants set to flood the US once Title 42 expires this week.)

The drone footage also shows an “enormous line” of illegal immigrants who recently crossed into Brownsville. Fox News correspondent Bill Melugin, who shared the footage, noted that a large majority of the illegals are single adults.

“Nonstop flow of illegal crossings here in Brownsville. Working on scripts in my car and look at the window and see another large group gathering for processing after crossing over,” wrote Melugin on his Twitter account. “Border Patrol buses have been coming and going constantly. It’s going to be a very busy week.”

Brownsville is one of the key spots along the border where officials have noted that the illegal immigrants are congregating in the thousands in order to cross, with the other notable crossing points being El Paso, Texas and Yuma, Arizona. But similar situations are developing and getting worse all along the nearly 2,000 miles of the U.S.-Mexico border.

“We cannot control the movement of people before they reach our border,” Mayorkas told “Good Morning America” host George Stephanopoulos. “Our responsibility attaches once they are in our custody.”

Mayorkas predicted during testimony before the Senate Homeland Security Committee at an April 18 hearing that there would be a surge of migrants after Title 42 expired. The Trump-era border policy expired Thursday at 11:59 p.m.

Mayorkas has claimed that the border is not open on multiple occasions, including during a Wednesday press conference where he ignored questions from Daily Caller News Foundation investigative reporter Jennie Taer.

Over 1.2 million illegal immigrants have been encountered at the U.S.-Mexico border during fiscal year 2023, according to data released by United States Customs and Border Protection (CBP), following 2,378,944 encounters in fiscal year 2022 and 1,734,686 in fiscal year 2021, while Fox News reported that 600,000 migrants evaded CBP in fiscal year 2022.

The Daily Caller News Foundation obtained documents detailing the Biden administration’s plans to allow illegal immigrants to be released on “parole with conditions” without any means to track them or giving them court dates. U.S. District Judge Kent Wetherell halted the Biden administration’s proposed “quick release” program Thursday, following a lawsuit by Republican officials in Florida.

Taer said during a Thursday appearance on Newsmax that word of mouth from migrants entering the United States was encouraging other illegal immigrants to come, despite Mayorkas’ statements to the public.

“Migrants are coming across, they’re getting released and they’re telling their families that are south of the border that that’s happening and that’s really the message, I think, that’s resonating with migrants,” Taer said.

The end of Title 42 COVID restrictions today is expected to bring a flood of illegal aliens trying to cross the southern border. Illegal border crossings have been exceeding 10,000 a day in anticipation. How did we get to this point?

To hear the Biden administration tell it, the border is secure and a new rule will make people crossing illegally at other than approved entry points ineligible for asylum. This nod to border enforcement is just for show and completely meaningless, as I will demonstrate in a minute.

But to answer the question how we got to this point, the answer is the Biden administration’s open borders policies and unconstitutional refusal to enforce the nation’s immigration laws. In previous commentaries, I’ve documented more than three dozen policy changes the Biden administration has made to open the border. Today, I add a dozen more:

Joe Biden said he would veto the House Republican border security bill that would end catch-and-release and build the wall so, right off the bat, you know he isn’t serious about securing the border
a federal judge ruled Joe Biden’s ‘catch and release’ policy is unlawful and rebuked Biden for policies that have reduced the border into a “meaningless line in the sand”

the annual ICE report shows significant cuts to immigration enforcement in the interior compared to the Trump years. This is part of ICE’s ‘sanctuary country’ policy that protects illegal aliens from deportation. Deportation numbers are way down.
and last, but not least, Joe Biden announced plans to expand Obamacare to accommodate DACA recipient DREAMERs.

Now back to Joe Biden’s new asylum rules: Excuse me, if I view Biden’s new asylum policy with a jaundiced eye, given the dozen new open borders policies I just mentioned. First, illegal aliens have to be caught to lose their right to claim asylum, but everybody knows most illegal aliens get away and are never apprehended. Second, the new rule is “riddled with exceptions”, 22 Republican state attorneys general have said. One exception big enough to drive a truck through is the fact the rule does not apply to designated legal pathways for illegal aliens to enter the country. So the rule won’t apply to illegal aliens coming through one of the more than 100 processing centers the Biden administration is building in other countries throughout the Western hemisphere. So, many more will be flown in, asylum claims intact. Same goes for approved border crossing points. The rule also doesn’t apply to unaccompanied minors, claimed medical emergencies, illegal aliens scheduling an appointment through the mobile phone app, or those aliens arguing ‘other circumstances’ if they can talk fast enough. Overall, the new policy is a shell game and the Biden administration’s orientation remains one of accommodation, not enforcement.

House Passes Immigration Bill Restarting Border Wall Construction

The House of Representatives passed legislation along party lines Thursday that would restart construction of the border wall and reinstate the Migrant Protection Protocols (MPP) asylum policy.

All voting Republicans except for two supported the Secure the Border Act, with all 211 voting Democrats opposing the legislation. GOP leadership negotiated with rank-and-file members over provisions dealing with seasonal labor and drug cartels up until passage. The legislation is not expected to pass the Senate, but it could jump-start negotiations in the upper chamber for a broader deal.

The Secure the Border Act directs the Biden administration to resume building parts of the border wall that were previously scheduled for building by the Trump administration. The Trump administration built 452 miles of wall along the southern border, while the Biden administration has been slow on its promise to fill some gaps. Biden overturned the emergency declaration that Trump relied on for border wall construction on his first day in office.

The House hoped to pass this bill over the winter but the GOP struggled to find consensus. But they were able to pass the bill today to coincide with the end of Title 42.

Biden also eliminated the MPP, which required asylum seekers to remain in Mexico while their legal proceedings were being adjudicated. MPP formally ended in 2022, after Republican-led states lost a legal challenge that would have forced the Biden administration to maintain it. The legislation reinstates the policy.

The Biden administration will allow Title 42 to expire Thursday night, making passage of the border bill more urgent, Republican representatives argued. Federal agents are being deployed at the southern border ahead of an expected migration surge, and U.S. Immigration and Customs Enforcement (ICE) officers are being instructed to release migrants already in custody to increase bed space in shelters.

“It’s the obvious advertisement shown to everybody around the world that it’s time to invade the southern border and come on across,” Georgia Rep. Mike Collins told the Daily Caller. “You can tell that by the tens of thousands of people lined up there and ready to go. We had 11,000 yesterday.”

GOP leadership made last-minute revisions to provisions dealing with E-Verify. Members representing agriculture-heavy districts worried the bill could cause worker shortages if the eligibility system were immediately made mandatory and applied to seasonal workers. Leadership promised members they would work to address the issue during negotiations with the Senate.

“What they committed to is that nothing would go to the president’s desk to be signed into law that didn’t have both the E-Verify provisions and reforms to the ag labor program,” Washington Rep. Dan Newhouse, a key moderate, said.

LA City Council Set to Pay Terror-Linked Group to Fight Deportations

On April 17, the Los Angeles City Council voted unanimously to pay a dangerous Islamist organization to provide legal representation to immigrants facing deportation.

The Council on American-Islamic Relations (CAIR) has a history of defending high-risk Muslim immigrants involved in terrorism-related offenses. With the mayor’s approval, CAIR’s LA chapter will soon receive portions of a $4 million grant to represent “detained and non-detained” migrants in removal proceedings.

CAIR-LA’s contractual services are part of a public-private partnership called RepresentLA, a citywide program that promises to provide due process for immigrants. CAIR is one of a handful of nonprofits tasked with supporting “affirmative immigration relief” with taxpayer and private foundation monies.

Los Angeles is a “City of Sanctuary,” and since state laws and city policies prohibit local police from questioning or detaining a person based on citizenship status, many of the “detained” deportees that CAIR is now tasked with defending may be incarcerated for more serious offenses. The city’s contract with CAIR comes as “interior deportations” under the Biden administration have reached record low numbers, according to Todd Bensman, National Security Fellow at the Center for Immigration Studies.

“If they’re facing deportation proceedings,” Bensman told Focus on Western Islamism, referring to detained immigrants, “there’s probably some highly derogatory national intelligence information on them, because the Biden administration does not deport.”

With help from CAIR, activist judges may find cause to block deportations and release more illegal immigrants into American cities. Still more alarming, CAIR’s history of activism and legal maneuvering on behalf of immigrants suggests that deportees suspected of serious terrorism-related offenses may soon benefit from a taxpayer-funded legal defense….

CAIR-LA, set to receive its portion of a $4 million grant to defend deportees, has its own history of advocating for criminal immigrants. In 2004, the LA branch held a townhall meeting to discuss the government’s alleged “targeting” of Muslim religious leaders, including Wagdy Ghoneim and Abdul Jabbar Hamdan….

Border Patrol agents have been instructed to begin releasing illegal migrants into the country without a notice to appear in court as officials prepare for the expected surge in immigrants crossing the southern border, according to documents exclusively obtained by the Daily Caller News Foundation.

Border Patrol Chief Raul Ortiz sent the instructions Wednesday, asking senior officials in the agency to begin the mass parole of illegal migrants ahead of the end of Title 42, a Trump-era expulsion policy, on May 11. The illegal immigrants will be “parole[d] with conditions,” meaning they are required to schedule a court date with Immigration and Customs Enforcement (ICE) or request service of a Notice to Appear (NTA), according to the instructions.

However, the paroled illegal migrants will be released without any tracking technology, meaning there is no way to supervise them after their release, according to NBC News.

Those paroled into the country will be screened by Border Patrol for their criminal and immigration history, and will be assessed by agents on a case-by-case basis.

Border sectors should request to use parole with conditions if either holding capacity is over 125%, agents across the southern border have apprehended 7,000 migrants per day for more than 72 hours or migrants are spending an average of over 60 hours in custody, according to the instructions.

Although paroling illegal immigrants into the country is inevitable with the expected surge, it nevertheless poses a risk to national security, a Department of Homeland Security official, who requested anonymity because they weren’t authorized to speak publicly, told the DCNF.

“There is no other option than to parole. It will make it easier for the processing agent and for the facility to get people out. Of course that will be the route that will be taken. There is no way you can do vetting when you have 4,000 in custody. You just have to parole them,” the official said.

Border agents have recorded an average of 8,750 encounters per day for the last week, which is double the average daily encounters during the height of a surge in May 2019, according to the instructions.

“This memorandum describes a policy concerning when CBP (Customs and Border Protection) may exercise its discretionary parole authority for urgent humanitarian reasons or a significant public benefit, including where there are conditions requiring the expeditious processing of noncitizens in exigent circumstances in order to ensure (1) appropriate and safe conditions for the health and safety of individual noncitizens in custody and (2) USBP’s continued ability to carry out its critical border security and enforcement mission,” the instructions state.

Border agents are not permitted to parole illegal migrants that are determined to be “unmitigable” flight risks, national security risks, public safety threats or unaccompanied children, according to the instructions.

On Friday, Department of Homeland Security Secretary Alejandro Mayorkas claimed on “NBC Nightly News” that “the border is secure.” The statement comes as the number of apprehensions at the U.S.’s southern border has spiked to record highs, with an additional surge expected in the coming days when Title 42 expires. In response, border state officials say they are preparing to take immigration enforcement into their own hands due to a lack of effort from the federal government.

On Sunday, reports surfaced that migrant apprehensions had reached 9,000 per day, significantly up from the previous high during Joe Biden’s presidency of 7,200 per day and “the second-highest month in Border Patrol history.” Indications are that the surge will only increase in the coming days due to the expiration of Title 42, which is set to end on May 11. Title 42 is a pandemic-era policy that allowed border officials to quickly expel migrants. Lawmakers on Capitol Hill from both sides of the aisle are expressing frustration over what they say is a lack of preparation for the expected surge on the part of the White House.

“[W]e need the Biden administration to act, and to act fast,” said Rep. Ruben Gallego (D-Ariz.). “I’ve heard directly from leaders in our border communities … [who] are simply unequipped to handle the surge of migrants that are expected when Title 42 ends.” Senator Krysten Sinema (I-Ariz.) was equally concerned about the Biden administration’s actions, or lack thereof. “Just today [Sunday], I was on the phone with a sheriff of Cochise County. He has gotten no information from the Department of Homeland Security or the federal government about what the flow is going to look like, about what they can expect for processing in terms of how long it takes to process migrants. He’s got no information.”

In response to the Biden administration announcing that 1,500 active-duty troops would be deployed to the border to “serve in administrative roles and not perform any law enforcement function,” Sinema was blunt. “It is a border of over 2,000 miles … so 1,500 troops isn’t gonna get the job done. That’s just the reality.”

The concerns come as a new report reveals that Customs and Border Protection (CBP) and Immigration and Customs Enforcement (ICE) agents are “overwhelmed, overworked and frustrated” and “stretched to their breaking points,” with almost 90% of employees in both agencies saying they do not have enough staff to handle an additional migrant surge. The report noted that despite “increasing border encounters and travel volume … staffing levels have remained the same, with CBP and ICE using details and overtime to temporarily fill staffing gaps along the Southwest border.”

As a result, Texas Governor Greg Abbott (R) announced Monday that a new “Texas Tactical Border Force” made up of 545 specially trained Texas National Guard troops will be deployed at “hotspots along the border to intercept, to repel and to turn back migrants who are trying to enter Texas illegally.” The governor said that the troops will be used to strengthen Operation Lone Star, which has already repelled 37,000 individuals attempting to cross the border illegally, arrested 27,000 criminals, including “cartel gang members” wanted for crimes including murder, and seized “enough fentanyl that would have been enough to kill every man, woman, and child in the United States.”

On Friday’s edition of “Washington Watch with Tony Perkins,” Rep. Nathaniel Moran (R-Texas) further emphasized the need for border states like Texas to assume responsibility for protecting the border.

“[H]ere in Texas, for the past couple of years, there’s been lots of talk about do we actually look at the U.S. Constitution and say, ‘Is this an invasion?’” he noted. “Luckily, Governor Abbott in the last year declared this is, in fact, an invasion across our borders. … The Constitution makes clear that it should be a federal operation for us to secure our borders. But when the federal government is unwilling to do so, states have no choice.”

“States like Arizona and Texas are the ones that are leading the way,” Moran concluded. “But I can tell you here in Texas … we recognize that there is a need to fill the gap where the federal government has failed over and over again.”

MIAMI – Four migrants from Iraq arrived at Miami Beach by boat on Friday, according to the U.S. Border Patrol.

The migrants abandoned the boat on the beach, north of Collins Park, at 2100 Collins Ave., and the W South Beach, a luxury hotel, near the Miami Beach Boardwalk.

Chief Patrol Agent Walter Slosar, who is based out of South Florida described the incident as a “suspected maritime smuggling event”…
